Jack Daniel Distillery — Engraving Services
By submitting a request for engraving at the Jack Daniel Distillery, you agree to be bound by the terms and conditions set forth herein (the "Terms and Conditions").
In the paragraphs below, the terms "you" or "your" means the individual signing this document and the company or business he or she is signing on behalf of (if applicable); "Product" means a product or product(s) in the Jack Daniel's line; "personalize" means the act of etching, engraving or otherwise personalizing a Product; "intellectual property" means any copyright, trademark, trade name, service mark, service name, brand mark, brand name, logo, corporate name, right of publicity, Internet domain name or industrial design and any other intellectual property right recognized at law.
You will not personalize a Product with any Jack Daniel's intellectual property unless we have given our prior written permission. Our intellectual property includes (among other things):
You will not personalize a Product in a way that infringes third party intellectual property rights. Words, phrases, logos and designs that may infringe third party intellectual property rights include (unless the owner has given its prior written permission):
You will not personalize a Product in a way that could damage the reputation of the Jack Daniel's brand or the reputation of the Product. Prohibited words, phrases, logos and designs include (among other things):
You will not personalize a Product with any words, logos or phrases that could mislead consumers into believing the personalized Product is an authorized limited edition or a new Product in the Jack Daniel's family of brands.
By submitting the engraving request, you warrant that you are at least 21 years of age.
Our acceptance of an engagement request may not be construed as an endorsement of the subject matter that has been engraved, and you agree to indemnify us for any claims against us relating to the engraving.
Your agreement with us is governed by, and will be construed in accordance with, the laws of the State of Tennessee.
If any provision of these Terms and Conditions is void or unenforceable, that particular provision (or part of that provision, as applicable) will be deemed omitted from these Terms and Conditions, and these Terms and Conditions will otherwise remain in full force and effect.
